In 2025, the federal exemption is approximately $13,990,000 (individual) or $27,980,000 (married couple). Amounts above the exemption are taxed at progressive rates from 18% to 40%.
Taxable amounts above exemption: first $10,000 at 18%, $10,001-$20,000 at 20%, $20,001-$40,000 at 22%, gradually rising to 40% for amounts over $1,000,000.
Estate tax is paid by the estate itself before distributions to heirs. Inheritance tax is paid by individual heirs based on their share. The federal government only has estate tax. Some states (KY, NJ, etc.) levy inheritance tax.
